US regulators are reviewing a defect petition that alleges Tesla robotaxis exceed speed limits in active school zones. NHTSA has not opened a formal investigation, but the filing adds to scrutiny of the Cybercab.

The National Highway Traffic Safety Administration is reviewing a defect petition covering approximately 1,000 Tesla vehicles. The petition alleges the company's robotaxis exceed posted speed limits inside active school zones, and it includes video evidence.

Petition targets Model Y and Cybercab units

The vehicles named are 2026 model year Model Y units and Cybercabs. A concerned party filed the petition, and NHTSA announced it on October 12, 2026.

However, this is not yet a formal investigation. NHTSA has said it will evaluate the petition to decide whether a full probe is warranted, and no formal investigation or recall had been launched as of October 12, 2026.

A second federal review of the Cybercab

The petition arrives while NHTSA is already auditing how the Cybercab was self-certified as compliant with Federal Motor Vehicle Safety Standards. The Cybercab lacks traditional driving controls, which raises questions about how it fits rules written for cars that a human steers and brakes.

Tesla began its Cybercab commercial service in Austin, Texas, in early September 2026. That launch prompted the audit, so the vehicle has drawn two separate lines of federal scrutiny within roughly a month.

Speed has also come up before. Alleged speeding incidents involving Tesla robotaxis in 2025 led to shareholder lawsuits and drew NHTSA attention.

What to watch next

School zone limits often apply only during certain hours or when lights are flashing, so a self-driving car has to recognize when the lower limit is active. If the petition's video shows cars failing that test, it points to a question about how the software handles conditional road rules.

If NHTSA opens a formal investigation, significant findings could push Tesla toward operational adjustments, including software changes to how the fleet handles speed limits.
